Questions
How is overtime pay worked out in Brazil?
Divide the salary by the hours divisor and add the premium. With R$ 2,200 and a 220 divisor, a normal hour is R$ 10 and an overtime hour at 50% is R$ 15. The CLT guarantees at least 50% (art. 59).
Which hours divisor should I use?
CLT art. 64 divides the salary by the hours in the month; for 44 hours a week that is 220. If your working week is different, use the divisor on your payslip or in your union agreement.
What is the DSR on overtime?
Regular overtime also counts toward the paid weekly rest (Lei 605/1949, art. 7). It is the month's overtime divided by the working days, times the Sundays and holidays of the month.
When is overtime paid at 100%?
Usually for work on a holiday or a rest day with no day off in return, which must be paid double (Lei 605/1949, art. 9). Union agreements can set higher rates.
